Terms of businessStandard terms of business www.car-lease.biz is a trading style of Aston Financial Ltd (“the company”), whose place of business is located at: Jupiter HouseHigh Street Tattenhall Cheshire CH3 9PXAll business conducted with www.car-lease.biz, is conducted with Aston Financial Ltd, and shall be governed by these terms. 1. Supply of goods or services 1.1. All goods or services, sold, supplied or arranged by the company shall be covered by these terms of business. 1.2. As far as permitted by law, the company excludes any liability for costs incurred by a failure to supply goods or services, or the late supply of goods or services, whether such costs are direct or indirectly incurred as a result of any failure to supply. 1.3. All quotes provided are not an offer to supply, and are subject to acceptance by the finance provider. The company reserves the right to correct any errors or omissions in any quotations provided, and shall not be bound by any quotes so affected. 1.4. The customer expressly understands and agrees that the price quoted is an indication of the final supply price, and prices may be subject to change before delivery if a vehicle manufacturer increases its prices or the cost of funding changes. The company will use its best endeavours to maintain the quoted price, but the customer agrees to pay the varied rate if applicable, or the reasonable costs incurred by the company if an order is cancelled. 1.5. Leased vehicles are subject to the terms of the finance provider, and the legal contract between the customer and the finance provider. The company is not a party to, or in any way liable as a result of, the agreement between the customer and the finance provider. 1.6. Should a customer cancel an order, or a finance provider refuse to complete on the provision of finance, then the customer shall be liable for any costs incurred by the company in relation to the cancellation of the order. 2. .Terms of Purchase 2.1. Orders shall not be binding, unless signed in writing by a director of the company. 2.2. The company shall not accept any liability for consequential losses, in the event of an order being cancelled by the company, however so caused. 3. General Terms 3.1. No variation to these terms shall be effective unless agreed in writing by a company director 3.2. These terms of business shall be governed by and construed in accordance with the laws of England. 3.3. Any delay or forbearance by the company in enforcing rights or obligations under these terms of business shall not be construed as a waiver of that right or obligation or of a right to enforce such right or obligation at any time thereafter. 3.4. If any of these clauses or conditions is not legally effective, the remainder of them shall be effective. The Company can replace any clause or condition that is not legally effective with a clause or condition of similar meaning that is. 3.5. Every effort will be made to carry out the contract but its due performance is subject to cancellation by us or to such variation as we may find necessary as a result of inability to secure labour, materials, or supplies or as a result of any Act of God, War, Strike, Lock-out or other labour dispute, Fire, Flood, Drought, Legislation or other cause (whether of the foregoing class or not) beyond our control. 3.6. Every effort will be made to carry any obligations entered into by the company, but its due performance is subject to cancellation by us or to such variation as we may find necessary as a result of inability to secure labour, materials, or supplies or as a result of any Act of God, War, Strike, Lock-out or other labour dispute, Fire, Flood, Drought, Legislation or other cause (whether of the foregoing class or not) beyond our control. 3.7. Title to goods purchased passes immediately on payment by The Company, and the seller of the goods acknowledges the right of The Company to remove goods from the sellers premises in the event of non delivery. The seller warrants that it has good title to any goods sold to The Company and the seller alone shall be responsible to any 3rd parties for any disputes regarding title to goods sold to The Company.
